1. Introduction

Welcome to Giftology. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the website or use our services.

2. Definitions

• "Company" refers to Giftology.
• "Service" refers to the personalized gift creation and delivery services provided by the Company.
• "Website" refers to the Giftology website.
• "User" refers to the individual accessing the Website or using the Service.
• "Gift" refers to the personalized product created by the Company for the User.

3. Account Registration

To use certain features of our Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use a strong password and to sign out of your account at the end of each session.

4. Gift Orders

4.1 Order Process

When you place an order for a gift, you agree to provide accurate and complete information about yourself and the gift recipient. The Company will use this information to create a personalized gift based on your specifications.

4.2 Consultation

After submitting your order, the Company will contact you for a consultation to discuss gift ideas. The final gift concept must be approved by you before production begins.

4.3 Payment

A 50% deposit is required to begin production of your gift. The remaining balance must be paid before shipping. All prices are in Egyptian Pounds (EGP) and include applicable taxes.

4.4 Delivery

The Company will make reasonable efforts to deliver gifts by the requested date. However, delivery times are estimates and not guaranteed. The Company is not responsible for delays caused by shipping carriers or circumstances beyond our control.

5. Cancellations and Refunds

5.1 Cancellations

Orders may be cancelled before production begins with a full refund of the deposit. Once production has started, cancellations will result in forfeiture of the deposit.

5.2 Refunds

If you are not satisfied with your gift, you must notify the Company within 7 days of delivery. The Company will work with you to resolve the issue, which may include replacement, store credit, or a partial refund at the Company's discretion.

6. Intellectual Property

The content on the Website, including text, graphics, logos, images, and software, is the property of the Company and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from this content without explicit permission from the Company.

7. User Content

By providing information or content to the Company for gift creation, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of creating and delivering your gift.

You represent and warrant that you have all necessary rights to the content you provide and that it does not infringe on the intellectual property rights of any third party.

8. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Egypt, without regard to its conflict of law provisions.

10. Changes to Terms

The Company reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
